These Terms govern your use of Better Built Ohio‘s website, products, and services. By visiting our site, requesting a quote, placing an order, or hiring us, you agree to these Terms. If you don’t agree, please don’t use our services.
1. Agreement to terms
These Terms form a binding contract between you (“Customer,” “you”) and Better Built Ohio LLC (“Better Built Ohio,” “we,” “us”). They apply to:
- Browsing and using our website
- Requesting quotes through our online intake forms
- Buying products from our showroom or online shop
- Hiring us for construction, remodeling, materials install, or service-call work
- Investor / contractor / wholesale relationships with us
Specific signed contracts (e.g., a construction agreement, change order, or DocuSign-signed estimate) take priority over these general Terms where they conflict.
2. Services we provide
Better Built Ohio provides:
- Construction & remodeling: kitchens, baths, additions, exteriors, multi-unit rehabs.
- Materials sales: cabinets, countertops, flooring (carpet, vinyl plank, hardwood), doors, windows, appliances.
- Installation: in-house crews and vetted trade partners.
- Service calls: plumbing, electrical, HVAC, handyman, drywall, painting, appliance repair, and other trades — dispatched through our service network.
- Pro measurement & design: in-home measure, 3D rendering, spec sheets, and quotes.
Service availability varies by location. Akron / Canton / Cleveland metro is our primary service area; jobs outside that region may incur travel charges or be declined.
3. Quotes & estimates
- Online intake forms generate auto-quotes at retail pricing. These are preliminary estimates, not final binding offers.
- Final pricing is confirmed after we review the intake, verify site conditions (typically a free in-home measure), and send you a final written estimate.
- Estimates are valid for 30 days unless otherwise noted. Materials prices fluctuate; estimates may be re-issued at current rates after expiration.
- Investor members receive 10–15% off retail on eligible product categories (applied on review, requires verified investor status).
- Tax (Ohio sales tax, currently 6.75%) is applied to applicable line items on the final invoice.
4. Orders & payment terms
- Cabinets: 100% on order. We pay the manufacturer upfront to lock in your color and build slot.
- Countertops: 70% deposit, 30% on install completion.
- Doors & windows: 100% on order.
- Flooring (carpet / vinyl plank / hardwood): 100% on order.
- Appliances: 100% on order.
- Service calls: Due on completion.
- Construction projects: Deposit + progress draws as agreed in writing.
- Custom projects: Documented per signed quote.
We accept: Melio (credit card), Zelle, CashApp, Venmo, cash, check, wire. Credit card payments via Melio may incur a processing fee. Returned checks incur a $35 NSF fee.
Late payments on outstanding balances accrue interest at 1.5% per month (18% APR) until paid, plus reasonable collection costs and attorney fees if applicable.
Title to materials passes to you only upon full payment. We retain a purchase-money security interest in unpaid materials until paid in full.
5. Delivery, scheduling, lead times
- Lead times shown in intake forms (e.g. “in stock — under 2 weeks,” “1–2 weeks,” “2–4 weeks,” “4–8 weeks”) are estimates based on supplier availability and current schedule.
- Lead times start when payment clears, the final order is locked, and site verification (if needed) is complete.
- We are not liable for supplier delays, shipping delays, weather, or events outside our reasonable control. We’ll communicate updates as soon as we know.
- Install scheduling is confirmed once materials are received and your site is ready.
6. Workmanship & warranties
- Workmanship: Better Built Ohio guarantees the labor on every install we perform for 1 year from completion. We’ll fix workmanship defects at no charge.
- Cabinets: 5-year manufacturer warranty on construction (frame, box, drawer boxes, hinges, slides). Door finishes covered per manufacturer terms.
- Countertops: per manufacturer warranty (typically 10–25 years on stone material; lifetime on seam workmanship by Better Built Ohio).
- Doors & windows: per manufacturer warranty (typically 10–25 years on the unit; install workmanship 1 year).
- Flooring: per manufacturer warranty (typically 10–25 years on LVP wear layer; carpet per spec).
- Service calls: labor warranted for 30 days against the specific defect repaired.
- Appliances: manufacturer warranty only.
Warranty does not cover: damage from misuse, abuse, accidents, modifications, normal wear, settling/movement of the home, water damage from leaks not caused by our work, acts of God, or damage caused by other trades after our work is complete.
7. Customer responsibilities
For us to complete your job efficiently, you agree to:
- Provide clear, safe site access during scheduled work hours.
- Disclose known site conditions (mold, asbestos, lead paint, hazardous materials, structural issues, plumbing/electrical age, etc.). Pre-1978 homes may require lead-paint protocols at additional cost.
- Secure pets and protect valuables. Better Built Ohio is not responsible for items left in the work area.
- Obtain HOA or condo board approvals if required.
- Provide accurate measurements when you choose the “I’ll type my measurements” intake option. Customer-provided measurements that turn out to be wrong may incur change-order fees and lead-time delays.
- Communicate changes or concerns promptly so we can address them.

Summary:
- Estimates can be declined at any time before you sign / pay.
- Once a deposit is paid or an order is placed, custom orders are generally non-refundable because we order materials immediately to lock in your build slot.
- Service calls: cancel free up to 24 hours before scheduled arrival.
- Change orders during a project are documented in writing and may affect timeline + cost.
9. Limitation of liability
To the maximum extent allowed by Ohio law:
- Better Built Ohio’s total liability for any claim arising from your project is limited to the amount you paid us for that specific project.
- We are not liable for consequential, incidental, special, or punitive damages (lost rent, lost income, alternate housing costs, etc.).
- We are not liable for pre-existing conditions discovered during the work (mold, rot, framing damage, code-non-compliant prior work, etc.). We’ll quote the additional work as a change order before proceeding.
- Nothing in these Terms limits liability for fraud, gross negligence, or anything that cannot legally be limited under Ohio law.
10. Disputes & governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
Before filing any legal action, both parties agree to attempt resolution by good-faith conversation. If unresolved within 30 days, disputes will be heard in the state or federal courts located in Summit County, Ohio, and you and we consent to the jurisdiction of those courts.
11. Website use
You may use this website for personal, lawful purposes. You may not:
- Scrape, mirror, or extract content without permission.
- Submit false information to our intake forms or contact us for the purpose of disrupting our business.
- Use the site to upload malicious code, viruses, or content infringing on third-party rights.
- Resell or republish content (photos, copy, pricing) without written permission.
All content (text, photos, designs, logos) is owned by Better Built Ohio or our licensors and protected by copyright. Customer-submitted photos and project drawings remain your property; you grant us a license to use them for completing your job, internal records, and (with your permission) marketing.
